All dealings with Bali Food Safari will be on these Terms and Conditions (Terms) unless otherwise agreed in writing with Bali Food Safari
1) The Bali Food Safari reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times for the Tour or Gift Certificate without notice. However, reasonable effort will be made to maintain arrangements as advertised.
2) Requirements to participate.
(a) All participants in the Bali Food Safari Tours (“Participants”) must hold a valid ticket, reciept,gift certificate or confirmation letter. Entry may be refused if tickets or vouchers are damaged or defaced in any way or not purchased from an authorised point of sale.
(b) The Participant acknowledges and agrees that it participates in the Bali Food Safari Tour at their own risk.
3) Bali Food Safari Tours ability to refuse participation.
(a)Bali Food Safari reserves the right to refuse any person, for whatever reason, participation in the Bali Food Safari Tour, in its absolute discretion, whether or not they have previously purchased a ticket. A person will be reimbursed for tickets previously purchased should they be refused permission to participate on grounds other than those set out above.
(b)During the Bali Food Safari Tour All Participants must obey the directions and instructions of the Bali Food Safari Tour guide, must not disturb other Participants or interfere with the Bali Food Safari Tours guide’s ability to conduct the tour in a safe manner.
4) Miscellaneous Terms.
(a) All Participants acknowledge and agree that Bali Food Safari’s expressly authorised to take photographs of Participants during the Bali Food Safari Tour and utilise such photographs for the purpose of advertising Bali Food Safari and the Bali Food Safari Tour including but not limited to being displayed on Bali Food Safari website (“Gallery”).
(b) Participant Photographs remain copyright to Bali Food Safari and may only be used or reproduced by Participants for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier’s products or services, without Bali Food Safari prior written permission.
5) Terms of payment.
(a) Bali Food Safari tickets are non-refundable (subject to Term 7(a) below) and specific to the Bali Food Safari Tour specified in the booking. Bali Food Safari Tours and Gift Certificates, rights or entitlements to Bali Food Safari Tours and Gift Certificates, must not be offered for sale or resale, or resold or used for any commercial purpose, including without limitation promotion of any supplier or any supplier’s products or services, without Bali Food Safari prior written permission.
(b) Bookings can only be changed up to 48 hours prior to the original tour date, and changed only by time or date to another available time or date, and not reduction in number of Participants. Bali Food Safari reserves the right to charge a booking fee ($10) on the purchase of tickets and an administration fee (15%) should tickets purchased be changed to another date or time.
(c) All must be paid for at the time of booking unless otherwise agreed by Bali Food Safari in advance.
6) Cancellation and refunds.
(a) Bookings can only be changed by the Participant by giving written notice to Bali Food Safari at least 72 hours before the original tour date.
(b) The Bali Food Safari Tour will not proceed should Bali Food Safari decide that the weather makes the participation in the Bali Food Safari Tour unsafe, or for any other reason, at the absolute discretion of Bali Food Safari.
(c) Should a Bali Food Safari Tour not proceed then Participants will either be re-booked at the earliest possible time at the convenience of the Participants taking into account available places, or be issued with a refund voucher in the case of purchases bought through an agent, or be reimbursed the price paid for the ticket. The relevant party who has sold the ticket to the Participant will make all reimbursements.
(d) There will be no refund of a ticket by Bali Food Safari except in accordance with these terms or as agreed in writing by Bali Food Safari. Refunds will only be made to the person who purchased the ticket from Bali Food Safari.
7) Bali Food Safari liability.
(a) To the extent permitted by law, Bali Food Safari excludes liability and will not be responsible for any loss, damage or injury arising from or connected with the Bali Food Safari Tour, no matter how that loss, damage or injury is caused. In particular, Bali Food Safari will not be responsible for loss or damage arising from a Participant’s failure to obey Bali Food Safari instructions or from any pre-existing medical or psychological condition. Further, but only to the extent permitted by law, Bali Food Safari will not be responsible for loss or damage arising from any negligent act or omission of Bali Food Safari or any person for whom Bali Food Safari is responsible. Certain laws imply non-excludable conditions and warranties. This provision does not exclude those conditions and warranties but limits Bali Food Safari liability in relation to these to provision of services provided by Bali Food Safari again, or refund of the cost of those services.
(b) Bali Food Safari is also not liable for any loss, damage or inconvenience arising from or incidental to any delay in the scheduled Bali Food Safari Tour taking place.
8) Agency.
Where an agent on behalf of Bali Food Safari enters into a sale, booking or any other transaction then that agent shall indemnify Bali Food Safari for any loss, damage or expense incurred by Bali Food Safari as a result of any misrepresentation, breach of contract or act of negligence by the agent.
9) Gift Certificates.
Terms applicable to the sale of Gift Certificates are as follows.
(a) Gift Certificates will be sold either for a specific Bali Food Safari Tour or for a specific amount. Gift Certificates are non-refundable but transferable. Gift Certificates must not be resold or used for any commercial purpose, including promotion of any supplier or any supplier’s products or services, without Bali Food Safari and a prior written permission.
(b) A Gift Certificate must be redeemed within 6 months from date of purchase and the Bali Food Safari Tour must take place within the 6 months.
10) Governing Law.
These Terms are governed by the laws of Western Australia, Australia. Bali Food Safari and each Participant submit to the non-exclusive jurisdiction of the Courts of Western Australia in respect of these Terms and any dispute between them.
